The Department for Business, Enterprise and Regulatory Reform (BERR) is planning to introduce new regulations to clamp down on unfair sales and marketing practices. This will mean that businesses will no longer have to face unfair competition from traders who use underhand tactics.  A commercial practice is unfair if it is not professionally diligent and it materially distorts, or is likely to materially distort, the economic behaviour of the average consumer.  The Consumer Protection from Unfair Trading Regulations 2008 set out broad rules for determining when commercial practices are unfair and also bans outright 31 specific practices.  These include: 

• Unbelievable Price, Literally – known as bait advertising
• Falsely stating that a product will only be available for a very limited time
• Faking Goods – misleading the customer into believing that the product is made by another manufacturer
• Falsely claiming that the business is about to cease trading or move premises
• Claiming that products are able to facilitate winning in a game of chance
• Asking for payment for goods not solicited by the consumer

The new regulations came into force on 26 May 2008. The regulations will only apply to unfair commercial practices that affect consumers. In order to ensure the level of protection overall, the Government indicated they will then be introducing the Business Protection from Misleading Marketing Regulations 2007 to govern business to business contracts.  These regulations will control comparative advertising by making misleading advertisements or indications a criminal offence.  It is important that all businesses, including service providers, begin to review their business practices thoroughly in readiness for the introduction of the new rules, to ensure that they comply with the law.
